About the agreement
The agreement will allow the Australian Government Minister for Sustainability, Environment, Water, Population and Communities to rely on specified environmental impact assessment processes of the State of Western Australia in assessing actions under the Environment Protection and Biodiversity Conservation Act 1999.
On 21 March 2012 the agreement was entered into by the State of Western Australia and the Commonwealth of Australia and replaced the previous bilateral agreement. In 2010, Western Australian environmental legislation was amended and included the implementation of a new form of Environmental Impact Assessment (EIA) process. This resulted in the development of a replacement bilateral agreement to accredit the new Western Australian EIA process.
