Environment Protection and Biodiversity Conservation Act 1999
Accreditation of a Plan of Management for the Purposes of Part 13

I, Ian Cresswell, Assistant Secretary, Wildlife Trade and Sustainable Fisheries Branch, as Delegate of the Minister for the Environment and Heritage, being satisfied that:

• The Management Plan for the South Australian Abalone Fishery 2004, and Scheme of Management (Abalone Fisheries) Regulations 1991 in force under the Fisheries Act 1982, to the extent that the Management Plan and Regulations are a plan of management for the South Australian Abalone Fishery, requires persons engaged in fishing under the Management Plan and Regulations to take all reasonable steps to ensure that members of listed threatened species, listed migratory species, cetaceans and listed marine species are not killed or injured as a result of the fishing; and
• The South Australian Abalone Fishery does not, or is not likely to, adversely affect:
  • the survival or recovery in nature of any listed threatened species; or
  • the conservation status of a listed migratory species, cetacean, or listed marine species or a population of that species,

hereby accredit the Management Plan for the South Australian Abalone Fishery 2004 and Scheme of Management (Abalone Fisheries) Regulations 1991, to the extent that the Management Plan and Regulations apply to the South Australian Abalone Fishery, pursuant to sections 208A, 222A, 245 and 265 of the Environment Protection and Biodiversity Conservation Act 1999 for the purposes of Divisions 1, 2, 3 and 4 of Part 13 of the Act.
